This Policy applies to the properties owned by Silhouette Island Resorts Limited. This Policy describes how your Personal Data is collected, processed, stored and used in accordance with our data protection standards and in compliance with the Applicable Laws. The continuous use of our Websites will constitute your express acceptance and consent to be bound by this Policy. We request you to properly read and familiarize with the contents of our Privacy Policy before you avail our services.

Our Websites are not intended for children and we do not knowingly collect their information unless that information is provided to us by the parents or guardians. We do not expect any child to forward us his Personal Data without consent of his/her parent or guardian.

In this Policy, the following terminologies have the meaning ascribed to them below.

“Personal Data” means any information relating to a Data Subject or an identifiable natural person one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Processing”, “process” or “processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

“Child” means a natural person below the age of sixteen (16).

“Special Categories of Personal Data” means the special categories of data as recognized in Article 9(1) of the GDPR.

We are committed to processing Personal Data in accordance with this Policy and the Applicable Laws. We adhere to the following Data Protection Principles in processing Personal Data;

  • accurate and where necessary kept up to date;

We may collect different types of Personal Data you provide to us. This may include data relating to the areas like your identity, reservation, contact details, payments, internet access. We have grouped them as follows. However, these groups are not exhaustive and there could be Personal Data that we collect which do not fall into any of the categories mentioned below.

  • Identity related information including full name, last name, middle name, first name, maiden name, marital status, title, date of birth, gender, nationality, passport number, copy of passport or identification document, visa information,membership number of loyalty programme, user name and password of the loyalty programme, country of residence, wedding anniversary, profession.
  • Contact information including email address, telephone number, mobile number, postal address, fax number, residential address.
  • Travel information including date of arrival, date of departure, estimated arrival time, estimated departure time, arriving flight, departure flight, boat transfers, sea plane transfers.
  • Reservation and profiling information including type of room, meal preferences, dietary requirements, food allergies, special meals, special requests, purchases from bar and restaurants, use of spa, preference for smoking, preference for non- smoking room, preferred type of bedding, preferred type of newspapers/magazines, sports,  cultural         interests,  your questions/comments/feedback during or following a stay, website accessed
  • Payment related information including credit or debit card information, card number, expiry date, card holder’s name, billing address and other billing information;
  • Technical information relating to your access to the Website and internet usage during the stay at Resorts;
  • Marketing and communication related information with regard to your preferences to receive marketing communication from us or third parties;
  • Career related information such as educational qualifications, professional experience, engagement with professional associations, Information about your contract of employments (or services) including start and end dates of employment, role and location, job responsibilities, working hours, details of promotion, salary (including details of previous remuneration), pension, benefits and holiday entitlement;

We may also collect your Personal Data which might fall into the category of Special Categories of Personal Data. We may hold and use any of these Special Categories of Personal Data in accordance with the Applicable Law. We may have to collect Special Categories of Personal Data relating to you to perform our contractual obligations to you or to comply with Applicable Law.

Personal Data may be collected from various means including;

  • when you make reservations at Resorts by directly engaging with us through our Website, email, telephone or any other means;
  • when you pre-check-in via our Website or check-in to Properties to avail our services;
  • when you avail facilities and services offered through our Website, create accounts in our Website, interact with our chat box, programme, subscribe to our news letters or new offers, participate in competitions, make complaints, provide feedback, participate in surveys;
  • when we administer your credit card payments including refunds to your bank account;
  • when we deal with your complaints or claims made in relation to the services we provide at the Resorts;
  • when you access our Website using your equipment, IP address, browsing action, patterns, your locations;
  • when complying with the Applicable Laws;
  • We ensure that we process your Personal Data only on the following grounds.
  • Consent – This means Data Subjects have granted express consent to us to process their Personal Data. We ensure that Data Subjects are informed of the purposes of the processing before we obtain the consent and collect Personal Data.

In obtaining the consents of Data Subjects, we ensure that request for consent shall be presented to Data Subjects in an intelligible and easily accessible form, using clear and plain language. We will maintain the records of consents given by Data Subjects to demonstrate the consenting by Data Subjects.

Where the Personal Data relates to a Child, the consent needs to be given by the holder of parental responsibility over the Child. Where we rely on the consent of the Data Subject to process Personal Data, Data Subjects are offered to withdraw the consent.

  • Performance of Contract – This means processing Personal Data is necessary to perform a contract we have entered into with the Data Subject or to take steps at the request of Data Subjects before entering into a contract with that Data Subject.
  • Complying with Applicable Laws – This means processing Personal Data of Data Subjects is necessary for us to comply with the Applicable Laws.
  • Public Interest – This means processing of Personal Data is necessary for the performance of a task carried out in the public interest or in the exercise of any official function assigned to us by the Government of Seychelles.
  • Vital Interest – This means processing of Personal Data is necessary in order to protect the vital interests of the Data Subject or of another natural person.
  • Legitimate Interests – This means legitimate business interest pursued by us or third parties. Serving our guests with the highest standard of service, continuously improving our service standards, dissemination of information regarding our new promotions are part of legitimate business interests. We ensure that we consider any impact on the Data Subjects and his/her rights before we process any Personal Data to achieve any Legitimate Interest of ours. Except in the instances where the Applicable Laws require or the Data Subject has consented to the processing, we will not process Personal Data of Data Subjects to achieve our Legitimate Interests when the impact on that Data Subjects overrides our interests.

We indeed respect the rights of Data Subjects to restrict the processing of his/her Personal Data and to object for the use of his/her Personal Data. We will honour such requirement of Personal Data unless there is a compelling legitimate ground for the processing such Personal Date like exercising our legal rights, defending a legal claims or complying with Applicable Law.

Your Personal Data will be stored by us. In addition, we share your Personal Data with third parties whose services are required to perform our contract with you, in compliance with Applicable Laws. In addition, we will share your Personal Data with third parties where you have consented to.

The external parties with whom we may share your Personal Data include;

  • Service providers, contractors and agents acting as processors who provide services such as transportation, airport pick-ups, diving, snorkeling, spa treatment, insurance, recreational services, contact centers, advertising, marketing etc.;
  • Tour operators dealing with us;
  • Professional advisors including lawyers, bankers, auditors and insurers providing services to us;
  • Internet payment gateway service providers, banks, credit card companies, debit card companies and other financial service providers providing services to us;
  • Any law enforcement authority, governmental ministries or governmental institution such as Police, customs, immigration, inland revenue, public health
  • Diplomatic missions in Seychelles and any other

In all these instances where disclose your Personal Data to external parties, where possible, we will strive to maintain that we disclose that Personal Data only to the extent of necessity, those Personal Data are treated in accordance with Applicable Laws and those Personal Data is not used for their own purposes. We will endeavour to ensure that those Personal Data are dealt with only for the specific purpose for which it is disclosed.

We host all the Personal Data that we collect in Seychelles and in the cloud environment. In instances where we transfer Personal Data to third parties based outside the European Economic Area for our business purposes or to perform our contract with you, we ensure that protection is available to the Personal Data by ensuring at least any of the following safeguards is implemented.

  • The non-EEA countries to which we transfer Personal Data have already been deemed by the European Commission as to providing an adequate level of
